Statement of Case:
This is an action by the Plaintiff James Headrick seeking damages that he affirmatively states were caused by a motor vehicle accident that occurred on May 10, 2016 on Highway 65/69 in Warren County, Iowa. The Plaintiff alleges that the Defendant Ismael Figueroa was negligent and that his negligence was a cause of his injuries. The Defendant denies that he was negligent, alleges that Plaintiff was negligent and denies the extent of Plaintiff’s damages. Plaintiff denies that he was negligent and affirmatively states he was faced with a sudden emergency created by the Defendant.
