Statement of Case: Plaintiff and Defendant were on a two lane highway during a snow storm. Plaintiff’s vehicle was slowing to make a right hand turn and was rear-ended by Defendant. Defendant admitted the accident occurred, but alleged that he was legally excused from liability under the sudden emergency defense. Defendant also argued that Plaintiff was comparatively at fault for the accident.
