Statement of Case:
This case arises from a two-vehicle motor vehicle collision that occurred on September 8, 2023, in Mitchellville, Polk County, Iowa, between Ellen Tope and Defendant Mary Winterbottom. Plaintiff Kathleen Tope, individually and as Executor of the Estate of Ellen Josephine Tope, and Plaintiff Timothy Tope claim that their mother, Ellen Tope, sustained injuries that caused her death on September 11, 2023. Defendant accepts some fault but claims Ellen Tope was partially at fault for this accident. Defendant denies that this accident was the cause of Ellen Tope’s death and claimed damages. |

| Plaintiff alleged Ellen Tope suffered bilateral rib fractures, a sternal fracture, a left iliac wing fracture, a laceration of the dorsum of the right foot with transected fourth digit tendon, a right forearm skin tear, an occipital scalp laceration, and a forehead laceration along with other scattered abrasions and small lacerations. Ms. Tope was transported from the accident scene by ambulance to the hospital where she remained until her death on September 11, 2023. Attached as PDF.
