In this case Gohlinghorst Excavation is seeking payment from New Cooperative, Inc. for services provided to New Cooperative involving the cleanup of an environmental spill of fertilizer and other contaminants into the Tarkio River near Stanton, Iowa on December 1, 2023. New Cooperative and Gohlinghorst Excavation entered into an oral contract for Gohlinghorst Excavation to clean up and remediate the spill. The status of the contract is not at issue in the case. New Cooperative admits it owes Gohlinghorst an amount of money. However, New Cooperative disputes the amount claimed by Gohlinghorst. The only issue for you to decide is the amount of money New Cooperative owes to Gohlinghorst. |
