Statement of Case: In this case Plaintiff alleges Virginia Gay Hospital was negligent in permitting Judy Lint to be left unattended in the ER while using the commode having just suffered a seizure and then suffering a second seizure while on the commode, causing her to fall and fracture some vertebrae in her back. Defendant denies it was negligence because Plaintiff allegedly insisted on being left unattended for privacy reasons while using the commode.
